Robin,  in 2008 I took a plea arrangement but the monitor was not part of the pleat but at the very end the Judge  added it as well as ordering no contact with the victim for the rest of my life. That law wasn&#039;t even passed until 2009. Yes the monitor is ordered by the Sheriff. Thanks anyway. I wasn&#039;t really asking for legal assistance from NCRSOL.

Thanks for the reply. Yes I have attempted to seek legal assistance  but being an elderly person on limited income, I con not afford the high prices of a paid attorney. My only option up to now is to just accept my fate and wear it until I die. But I know in my heart that I have recovered form this most debilitating disease of sexual addiction because that is what it was. I also overcame the disease of alcohol addiction and now seek to help others who are seeking help in the recovery process. My life now entails staying at home virtually 24/7 except for going to AA meetings because of fear I might accidentally stray into an exclusion zone as they will not tell me where those exist until it&#039;s too late. Thank you for all you, NCRSOL, and NARSOL are doing on my behalf.]]></description>

five year post release that I was mandated to complete as well as a certificate of completion from the sex offender class  that I was required to complete. The legal document reads, quote,&quot;The Post-Release Supervision and Parole Commission does hereby certify that pursuant to Sections 13.1/13.2 of the General Statutes of North Carolina, ALL Rights of Citizenship which the said: (my name) forfeited  on conviction are by Law automatically restored.. Signed and Witnessed. Yet I am required to wear this Monitor for the rest of my life. Prior to conviction I was not requires to wear it and all of my movements were not being tracked 24/7. why is this not challenged? I read a part of the decision but I still do not understand why the courts still refuse to understand and allow laws to keep anyone who has been convicted of a Sex Offense from ever ever regaining all rights guaranteed under the US and State Constitutions. I could see using SBM while on Post-Release, Probation, and Parole to try to keep people in check so they would be more likely to complete their outside time correctly but for years is unreasonable no matter how you look at it. The STATIC 99 form that is used to determine if an offender is low risk to high risk is bias and possible not legal if you clearly read all questions it ask. I should know. I am being forced to wear an bracelet for 10 years.....10 yrs and even though that time is near it has made it very difficult to do anything &quot;normal&quot; because of its limitations. So go read up on the STATIC 99 and you will understand. The laws regarding Sex Crimes are unjust and needs to be removed and redone. I understand we want to protect society from REAL dangerous people but when does it constitute going...TO FAR. Sex Offenders are NOT second class citizens as long as you have done your time and done what is required by law but to have ongoing requirements outside of jail and prison is absurd. Why is there no ongoing requirements and punishments for ALL other crimes committed? hmm. Maybe the State and Federal governments should wear the ankle monitors for a yr and be subjected to the same punishments if they fail to maintain it as if they wear a SO to see how it feels. Time to take back our freedoms from those who are destined to take it away.]]></description>

It looks like the Gentle case is awaiting a decision from our state Supreme Court. It was my understanding that that case decides whether lifetime SBM without a reasonableness test of some kind is unconstitutional/invalid pending that test. Further, I had assumed one could avoid expensive legal action to remove one&#039;s self from monitoring with a favorable decision, being that the vast majority of lifetime enrolees in NC were mandated to monitoring before there was a post-Grady &quot;reasonableness&quot; test.]]></description>
